REUTERS/Brian Snyder Actor Kevin Spacey arrives at district court on Monday, Jan. 7, 2019, in Nantucket, Mass., to be arraigned on a charge of indecent assault and battery.

Kevin Spacey has finally had his day in court. The judge ordered the disgraced actor must stay away from the young man.

Judge Thomas Barrett also granted a request from Spacey's defense attorney, Alan Jackson, who asked that texts between the young man and his girlfriend be preserved, covering a period of six months past the date of the alleged assault.

Dressed in a grey suit and tie, Spacey did not speak during the brief pre-trial hearing, but his lawyers entered a plea of not guilty on his behalf.

Spacey, 59, will not have to appear in March, the judge ruled, but he will need to be available by phone.

Separately, in September, the Los Angeles County District Attorney's office said Spacey would not be prosecuted over an accusation of sexual assault that allegedly took place in 1992.

The 18-year-old said he told the actor he was a 23-year-old college student.

The accuser's attorney, Mitchell Garabedian, issued a statement Monday saying his client hopes to serve as an example to other victims.

After meeting the actor and telling him he was 23 years old - the legal drinking age is 21 in MA - he said he started drinking first beer and then whiskey with Mr Spacey at his urging.

It is the first case against him to be prosecuted since a number of sex assault and harassment claims were made at the end of 2017.

After the formal charge against him was announced, Spacey released a video in which he seemed to attempt to refute the charges.

The victim is the son of former Boston television news anchor Heather Unruh.

If convicted of felony indecent assault and battery, the 59-year-old two-time Oscar victor could face as many as five years in prison.

The first public allegation of abuse came from actor Anthony Rapp, who claimed that Spacey sexually assaulted him when Rapp was 14, in 1986.

Spacey had been silent since his apology until late December, when he posted a video to his Twitter account speaking directly to the camera in the persona of his "House of Cards" character Frank Underwood.
